The international rule of law is often seen as a centerpiece of the modern international order. It is routinely reaffirmed by governments, international organizations, scholars, and activists, who credit it with reducing the recourse to war, preserving human rights, and constraining the pursuit of state self-interests. It is commonly seen as supplanting coercion and power politics with a framework of mutual interests that is cemented by state consent.

The paper asks whether humanitarian intervention is legal and reviews contemporary legal arguments on both sides. It finds that both views are sustainable by conventional accounts of the sources of international law; humanitarian intervention is at once legal and illegal. The paper then considers the implications of this for the idea of the rule of law in world politics. The power of international law in this case comes from its utility as a resource for justifying state policies, not as a (...) means for distinguishing compliance from non-compliance. Charles Taylor is a philosopher concerned with morality and the nature of the identity of individuals and groups in the West. This book offers an evaluation of Taylor's conception of self, and its moral and political possibilities.

Charles Taylor is quite rightly ranked as one of the leading philosophers writing in the world today. As such, his recent endorsement of Catholicism as his preferred vision for the good life warrants careful attention. To this end, I examine the core aspects of his Catholicism that centre on four main themes: Catholicism as difference, the need for transcendence, the necessity for acts of 'unconditional love', and his support for Matteo Ricci's Jesuit mission of the 16th century as a model (...) to be followed for Catholics today. I argue that Taylor has severe weaknesses in all these themes, which cast great doubts on the viability of his Catholic vision for offering an orientation towards the good. (shrink)

Charles Taylor has recently stated his religious leanings as being at the core of his philosophical vision for a better society. At the heart of this vision is his emphasis on transcendence: that there is something beyond life as we know it. Some years earlier, Taylor had explicitly endorsed the work of Walter Benjamin and Ernst Bloch for the way he wanted to talk about the issue of transcendence; however, neither figures prominently in his recent writings. While there may be (...) differing reasons for this omission, my main concern in this article is to show how the issue of transcendence in Benjamin's and Bloch's writings offers an interesting comparison with Taylor's work on this issue. Moreover, Benjamin and Bloch will be shown to offer ways in which Taylor can more fully express his own undeveloped articulation of transcendence through a consideration of the themes of religion, God, time and death. While it is common to refer to the international rule of law, it is less common to define it or to explore what it means. In this essay I examine the international rule of law both in practice and as a concept. This is important because many controversies about the direction of world politics in fact rest on different accounts of the international rule of law. Understanding the various ways the idea is used, and their implications for policy-choices, can help (...) clarify what it and what it is not being argued over in global controversies. I set out three distinct approaches to the concept of the international rule of law and compare them to contemporary state practice. The first is anchored on the obligation of states to comply with their international legal obligations. The second draws on an analogy with the domestic rule of law. The third begins from the observation that states invoke international law to explain and justify their policies - from this it expands into a model of law as integral to political legitimation. I find that the third provides the most conceptually coherent understanding of the international rule of law, and has interesting implications for the study of international law and politics. Yo planteo tres enfoques distintos del concepto de imperio internacional de la ley y los comparo con la práctica estatal contemporánea. El primero está anclado en la obligación de los estados de cumplir sus obligaciones legales internacionales. El segundo traza una analogía con el imperio doméstico de la ley. El tercero parte de la observación de que los estados invocan la ley internacional para explicar y justificar sus políticas - de aquí se amplía a un modelo de la ley como parte integral de la legitimación política. Me parece que el tercero ofrece la comprensión conceptualmente más coherente del imperio internacional de la ley y tiene implicaciones interesantes para el estudio de la ley y la política internacionales. In A Secular Age Charles Taylor endorses Mikhail Epstein’s notion of ‘minimal religion’ as his preferred orientation to the good for Western secular society. This article examines the basis of Epstein’s ‘minimal religion’ which rests on the psychoanalytic theories of Sigmund Freud and Carl Jung. It is shown that Freud’s theories are incompatible with Taylor’s own thought, and in the case of Jung, Epstein fails to develop the latter’s contribution to our understanding of religion. Moreover, although Taylor endorses Epstein’s work (...) he makes no reference to Jung. To this end, the importance of Jung’s theories in relation to religion are elucidated and offered as a way to forge a dialogue between a nuanced humanist position and the theistic vision offered by Taylor. For Amartya Sen, Adam Smith’s notion of the impartial spectator is a device that brings “distant voices” into our moral deliberations in order to prevent us from the parochialism that can limit our views on particular issues. Whilst recognising its importance, this article suggests that there are some problems with the way Sen uses this in his The Idea of Justice. Tensions arise around issues relating to his interpretation of Smith, a one-sided and undialectical understanding of the operation of the (...) impartial spectator, an ambivalence in Sen’s approach between essentialism and cultural relativism, the capacity for people to carry out the demands of the impartial spectator and its efficacy in relation to real moral problems such as Smith’s case of infanticide. The conclusion is that in the search for openness, Sen leaves his idea of justice with insufficient grounding to forge a dialogue that can act as a challenge to entrenched beliefs rather than simply accept them in a limbo of fragile co-existence. Critically examines how radical political theory and its application to film analysis can provide insight to the aesthetic self during political upheaval and conflict.

Marx's comments on Hegel's philosophy have left an ambiguous legacy for Marxism. One pervasive theme, though, is the interpretation of Hegel's idealist philosophy as being shrouded in mysticism. Marx's main contribution, according to this view, was to demystify Hegel's thought through a more materialist dialectical approach. At the same time, however, there have been those who have sought to rupture this Hegel-Marx connection and purge Hegelianism from Marxism altogether. Appropriate and expunge have therefore been the two main responses to Hegel's (...) influence on Marxism. I will argue against these traditions, however, to assert a more direct relationship between Hegel's and Marx's dialectic. To do so, I want to identify some of the main Marxist thinkers that can be linked with the two main schools above. I will term these the Hegelian-Marxist Materialist Appropriators and the Idealist Expungers. In contrast I put forward the Hegelian-Marxist Materialist school which states that ultimately the dialectic of Hegel is the dialectic of Marx. Before this, I begin by considering some examples of Marx's critique of Hegel. The leitmotif of this critique is a depiction of Hegel's dialectic as mystical or idealistic in contrast to Marx's more materialist dialectic. As we shall see, such a criticism was begun by Marx, perpetuated by Engels as ‘orthodox’ Marxism and ultimately accepted even by those who sought to place themselves within an Hegelian-Marxist tradition. This paper reports on an interpretive research project which examines the feasibility of implementing social audit within the general medical practice setting. The study aims to communicate patients' voices to aid evaluation of the potential contribution of social audit to the public health sector and also addresses particular conceptual problems which arise when attempting to implement social audit within this environment. The fieldwork focuses on one general health practice in Lanarkshire (in southern central Scotland). Consultative focus group discussions and individual (...) interviews were carried out with a sample of twenty two patients. Patients were most concerned with health service organisational and delivery issues. Overall, the results suggest patients are enthusiastic about the ideas and process of the social audit. Patients were able to demonstrate a capacity for grasping accountability issues and balanced reasoning. There was an acute awareness of the constraints which exist in the public services. Patients addressed the broad rights and responsibilities issues, and highlighted the possible pitfalls of relying on a representational mechanism for ensuring their voices were heard. The study concludes that an involved and negotiative dialogue process of implementing social audit could provide beneficial understanding and ideas to the organisation which may be further researched. Ian Fraser offers a systematic, critical exploration of the nature of Taylor's Catholicism as it appears in his writings. This reply to Fraser endorses his belief in the importance of looking carefully at Taylor's religious views. However, it raises doubts about some of Fraser's particular arguments and conclusions, and aims to foster a (...) clearer understanding of Taylor's religious beliefs. It poses questions for Fraser about what Taylor is setting out to do in A Catholic Modernity?; why he invokes the figure of Matteo Ricci; whether he believes that acts of practical benevolence are impossible without a religious foundation; and whether his religiously-inspired pluralism suffers an inherent contradiction. In the late Middle Ages the philosopher and mystic Meister Eckhart preached that to know the truth you must be the truth. But how to be the truth? Eckhart's answer comes in the form of an imperative: release yourself, let be. Only then will you be able to understand that the deepest meaning of being is releasement. Only then will you become who you truly are. This book interprets Eckhart's Latin and Middle High German writings under the banner of an (...) imperative of releasement, and then shows how the twentieth-century thinker Martin Heidegger creatively appropriates this idea at several stages of his career. Heidegger had a lifelong fascination with Eckhart, referring to him as "the old master of letters and life." Drawing on archival material and Heidegger's marginalia in his personal copies of Eckhart's writings, Moore argues that Eckhart was one of the most important figures in Heidegger's philosophy. This book also contains previously unpublished documents by Heidegger on Eckhart, as well as the first English translation of Nishitani Keiji's essay "Nietzsche's Zarathustra and Meister Eckhart," which he initially gave as a presentation in one of Heidegger's classes in 1938. We regularly wield powers that, upon close scrutiny, appear remarkably magical. By sheer exercise of will, we bring into existence things that have never existed before. And, by mere resolve, we generate things that pose significant obstacles to others' exercise of liberty.
